Duties:

  • The position is located in the Office of the Architect of the Capitol (AOC), Office of the General Counsel (OGC). The Deputy General Counsel (GC) supervises the OGC staff and provides legal advice and counsel to the General Counsel and other AOC managers on a wide range of legal matters including construction contracts, service contracts, occupational safety and health matters, employment, labor management and employee relations, environmental issues, fiscal law, acquisition law, real estate, tort law, new legislation and interpretation of legislative intent, insurance and liability, and property acquisition management. In addition, the Deputy GC represents the AOC in administrative proceedings and serves at the pleasure of the Architect.

  • In coordination with the General Counsel, the incumbent is responsible for evaluation of current and proposed programs and operations; and recommendation of actions to initiate, modify, or discontinue initiatives as appropriate.

    Serves as an expert on all legal and factual matters; provides authoritative advice and assistance, and serves as the final source of legal advice on all policy and legal issues confronting the AOC; exercises substantial discretion in the consideration and resolution of legal matters to include confidential and sensitive issues which cut across organizational lines and affect the administration and resources of the AOC; provides advice on novel questions and responds to substantive and procedural questions concerning alleged violations of law or other areas of legal expertise; advises the Architect and other senior management staff on interpretations of specialized areas of law, and assists in planning policies affecting the AOC's position; and counsels senior management staff and officials at multiple levels of the AOC.

    Responsible for the formulation and administration of policies affecting the mission of the AOC. The Deputy GC specifically develops, evaluates, and implements policy for the AOC-wide programs; explores and plans long-range development plans, as well as short-term strategies; performs intensive and innovative legal research to prepare in-depth analyses, arguments, briefs, and analytical documents on a variety of complex and specialized fields of law where the research direction is not clear-cut or where the legal issues require the advice and guidance of experts; serves as the AOC expert in providing legal opinions and final advisory statements regarding high level policy or extremely complicated questions; acts as the principal attorney in charge of recommending the policies and developing the procedures and regulations implementing new or amended legislation for the AOC; ensures that the policies, procedures, and regulations are consistent with the intent of the law and are administratively sound, efficient, and economical in operation; and prepares briefs, legal interpretations, and background information.

  • The Deputy GC establishes and maintains effective working relationships with various high-level individuals including Members of Congress and their staff, Officers of the Senate and House and their staffs, executives from other legislative, judicial, and executive agencies, executives of major corporations, and distinguished members of the public; establishes and maintains close and cooperative working relationships with the Architect or jurisdiction/division management and officials, Government agencies, and other institutions with related interests in order to advance the programs and objectives of the AOC.

    The Deputy GC supervises a permanent staff of 8 attorneys and 4 support staff. The Deputy GC performs the human resource management functions relative to the staff supervised.

    Provides oversight and direction on the legal aspects of procurements with particular emphasis on required clauses, competitive requirements including disputes, and complex insurance and liability issues. The Deputy GC specifically provides advice and assistance to agency contracting officials on contracting procedures and claims avoidance. The Deputy GC prepares the AOC responses and represents the AOC before the Bid Protest forum of the GAO; and acts as liaison with the Department of Justice (DOJ) in bid protests brought before the U.S. Court of Federal Claims.

    Oversees the preparation of litigation reports to DOJ in suits filed against the AOC under the Federal Tort Claims Act, and acts as the AOC liaison with attorneys of the DOJ.

    Liaisons with DOJ Lands Division in real estate matters; provides advice, negotiates, and drafts permits and licenses regarding use of the facilities on Capitol Hill for various Governmental and nongovernmental functions; coordinates with counsel to other legislative branch offices and House committees and staff.

    Represents the AOC in negotiations and proceedings; advises on specific questions arising under environmental laws (including the Clean Air Act; Comprehensive Environmental Response, Compensation & Liability Act; Resource Conservation and Recovery Act, Federal Insecticide, Fungicide, and Rodenticide Act; and Clean Water Act); advises on local laws and regulations applicable to the AOC; and provides legal advice and assistance in matters involving Occupational Safety and Health Act issues under the Congressional Accountability Act (CAA).

    Reviews and analyzes facts and develops evidence during the preparation of cases that involve the most difficult and complex legal principles and issues where precendents are not clearly established; assists the U. S. Attorney's Office in conducting trials or presenting oral arguments in Federal district courts and courts of appeals; responds to telephonic or written inquiries from United States Attorney staff on matters of law, procedure, or policy in pending or potential litigation; performs special legal and administrative projects requiring broad experience and sound judgment; serves as the AOC's representative at administrative proceedings; produces reports and other documents on complex topics individually or as part of a team; independently plans, organizes, and coordinates major research and analytical efforts to produce professional reports which synthesize contributions by various legal specialists; and is responsible for ensuring completion of coordinated research products that synthesize issues and elements to produce a clear, concise, objective report responsive to the needs of the requestor(s).
  • Drafts legislation or prepares complete reports on changes in basic legislation involving all legal matters affecting the AOC; drafts or reviews proposed legislation; and evaluates the proposed legislation in terms of its foreseeable effect on AOC programs, policies, procedures, regulations, methods of operation, extent of operations, and on existing laws.

  • The Deputy GC also provides advice on the labor-management relations program, including collective bargaining agreements, grievance procedures, dispute resolution, and representation of the AOC in third party procedures, specifically, formulates legal policies and procedures which comply with the Congressional Accountability Act (CAA), and other laws; provides legal consultation and advice to all levels of management in such matters as grievances and complaints, EEO, administration of discipline, and non-disciplinary adverse actions; presents, or prepares management officials to present, management's position in third party grievance and appeals hearings such as those conducted by the OOC; oversees the litigation of formal unfair labor practice (ULP) complaints and hearings by providing advice on complex legal issues, participating in the negotiation of settlements, conducting depositions of witnesses, filing necessary briefs, and representing the AOC at hearings; and advises the Chief of the Human Capital Management Division (HCMD) on matters of labor law or administrative policy related to individual actions or actions affecting entire bargaining units of the AOC.
