The candidate selected will provide guidance to the General Counsel, the Deputy General Counsel and other top agency management officials on compliance with the Federal Acquisition Regulations, the Federal Acquisition Streamlining Act and the entire federal procurement process. The incumbent reviews major contracts, modifications, options and other significant procurement activities and provides advice to program managers, technical and financial specialists, co-workers and others on procurement issues, policies and requirements. Position requires comprehensive knowledge of pre-award and post-award acquisition program phases, from long-range planning and initial strategy through contract negotiation, award, administration and termination.
Incumbent must demonstrate skill in written communications required to review for legal sufficiency documents related to contract administration including awards, modifications, letters to vendors, analyses of cost and progress, letters of inquiry, reports of audit and investigations, and terminations.
The incumbent also assists the General Counsel and the Deputy General Counsel in advising top agency management and other CSOSA/ Pretrial Services Agency (PSA) staff in such areas as the handling and processing of litigation, the legal rights of offenders, interpretation of court judgments, orders and decisions and other legal matters pertaining to offender/defendant supervision issues.
.The incumbent provides legal advice and service to managers regarding the interpretation, applicability and impact of Federal laws on CSOSA/PSA programs; analyzes allegations of violations of prohibited personnel practices, and other related complaints; and confers with investigators and staff and advises agency management regarding legal issues involving labor-management relations and human resource management.
The incumbent may also represent the Agency before administrative agencies such as the Equal Employment Opportunity Commission (EEOC), the Merit System Protection Board (MSPB), and the Federal Labor Relations Authority (FLRA), and serve as co-counsel to Assistant United States Attorneys in matters before the United States Courts as necessary. As agency counsel, the incumbent conducts and/or directs discovery, legal research, and drafts pleadings and other legal memoranda in complex cases, and assists and advises other staff attorneys in the execution of these tasks in cases assigned to them.
The incumbent assists in the research and preparation of legal opinions regarding complex and novel questions of law, involving interpretation or application of legislation, court orders and administrative opinions, Executive orders, regulations and rules. Incumbent also prepares and reviews proposed agency policy involving multiple areas of law, statute, or regulations and works with agency staff to develop procedures and administrative or procedural regulations. Incumbent advises the Freedom of Information Act/Privacy Act (FOIA/PA) Office and other CSOSA/PSA staff on issues relating to the release of protected information and provides guidance to the General Counsel, the Deputy General Counsel and other staff on a wide range of issues including matters related to ethics, appropriations, procurement, criminal and federal administrative law.
